Dr. Kyle Nawrot is a dentist registered with the BC College of Oral Health Professionals. He owns and operates a dental facility in Abbotsford, BC. Dr. Nawrot is the subject of an earlier consent order dated February 4, 2020, which is still in force. Under the 2020 consent order, he was suspended for nine months (February 4 through November 3, 2020) and required to undergo extensive remedial education. Dr. Nawrot is currently in breach of the 2020 consent order, as noted below.
Background
Following an investigation into two patient complaints received by BCCOHP in 2021, the Inquiry Committee that oversees investigations directed that two citations be issued against Dr. Nawrot. A discipline hearing for both citations had been scheduled for September – October 2023, but was cancelled when Dr. Nawrot made admissions and made a proposal to resolve the citations under s.37.1 of the Health Professions Act.
Admissions
Dr. Nawrot has admitted that he committed the following acts of professional misconduct:
- Failed to respond to communications from the College in a timely manner.
- Provided treatment that fell below the College’s expected standards by (1) providing extensive restorative treatment in a single session rather than over multiple sessions and (2) performing restorative treatments that were not supported by the records and by removing tooth structure that was excessive in several teeth.
- Billed for treatment when the need for the treatment was not supported by records.
- Provided treatment without having sufficiently obtained or documented valid informed consent.
- Failed to maintain adequate patient records.
- Breached the 2020 consent order by failing to complete the ethics-based PROBE Plus course.
Resolution
A panel of the Inquiry Committee received and considered Dr. Nawrot’s proposal. In accepting the proposal from Dr. Nawrot, the Inquiry Committee issued an order on August 31, 2023. The order states that:
- Dr. Nawrot is reprimanded.
- Dr. Nawrot is suspended from practice for a period of 12 months (October 1, 2023 – September 30, 2024) during which time he cannot earn money from the profession or be involved in any aspect of patient care. He may be involved in administrative and financial aspects of any dental practice he owns.
- During the suspension, he must prominently post signage at his most recent location of practice to inform patients that he is suspended from practice.
- Dr. Nawrot must pay a fine of $6,000.
- Dr. Nawrot must pay $4,000 to BCCOHP towards the costs of the investigation.
- Before his return to practice, Dr. Nawrot must complete BCCOHP’s “Avoiding Complaints” course and the PROBE Plus course, or another program, approved by the College.
- Dr. Nawrot must ensure his staff completes a training session on managing and extracting clinical records from his dental records vendor.
