In accordance with s. 39.3 of the Health Professions Act, the following public notice is given:
Name of Registrant: Pavle Djordjevic (“Registrant”)
Action taken:
The Inquiry Committee of the College of Dental Hygienists of British Columbia (the “College”) directed the issuance of a Citation under s. 33(6)(d) of the Health Professions Act, R.S.B.C 1996, c. 183 (the “Act”). On February 18, 2020, a hearing panel of the College’s Discipline Committee conducted a discipline hearing to inquire into the Registrant’s conduct to determine whether he engaged in professional misconduct as defined in s. 26 of the Act b: (a) failing to complete the Quality Assurance Program Assessment Tool (the “QAP Tool”) contrary to s. 52.1(2) of the College bylaws; (b) providing inaccurate or misleading information to the College on June 10, 2019 and July 3, 2019 regarding the basis for seeking an extension to complete the QAP Tool; (c) failing to notify the Registrar of the College that his address had changed contrary to s. 49 of the College bylaws;, (d) failing to discharge his duty to respond in a timely manner or at all to College communications and requests.
Notice of the citation was provided to the Registrant’s last address in the College register. The Registrant did not attend the Discipline Hearing.
On March 20, 2020, the Discipline Panel issued its Reasons for Decision. The Panel determined that the Registrant had engaged in professional misconduct by:
- failing to complete the QAP Tool by May 3, 2019 or at all, as alleged in the Citation;
- providing misleading information to the College on June 10, 2019 and July 3, 2019; and
- failing to discharge his duty to respond in a timely manner or at all to four College communications dated July 24, 2019, August 31, 2019, August 22, 2019 and September 24, 2019.
The Discipline Panel re-convened on September 13, 2020 to consider evidence and submission on penalty, costs and public notice. The Discipline Panel ordered a reprimand and declared that the Registrant’s conduct warranted the following measures, limits and conditions under sections 39(2) and 39(8):
a. The Respondent is suspended for a period of eight months:
i. The suspension will begin on the first day that the Respondent is granted reinstatement of registration in the event that he obtains reinstatement as a registrant of the College, and run for a minimum of eight months from that day;
ii. As conditions on the lifting of the suspension, the Respondent must do all of the following
before the suspension is lifted:
1. Successfully complete the College’s QAP Assessment Tool;
2. Complete the PROBE (Professional/Problem-Based Ethics) program at his own cost
and obtain an unconditional pass; and
3. Complete a reflective paper of not less than 2000 words (exclusive of references)
outlining his statutory and professional obligations as a registrant of the College,
including in particular his dute to respond to College communications and cooperate
with College investigations;
b. After the lifting of the suspension, the Respondent is subject to the following
conditions on his practice:
i. The Respondent must successfully complete any additional requirements arising from his completion of the QAP Assessment Tool within 30 days of the lifting of the suspension; and
ii. The Respondent must contact the College, by email or telephone, on the first business day of each month as long as he holds full registration; and
c. The Respondent must pay costs in the amount of $10,018.60 to the College within 30 days of
this order.
